Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

So the police local or the Feds cannot just search your person or home or car without a court order UNLESS you give permission. The courts have ruled that the "Frisk" upon arrist is not a unlawful search. But any other search is. Nor can they "seize what they will..(now I have read, I am an constitution teacher not a lawyer, so check with a lawyer,) if an illegal item is is plain sight it may be taken.
