Rule not by divine right but by social contract. Constitution 101

 As power began to shift from the Aristocratic to the young middle class; more and more members of the MC began to question the social system. WHY should not a man be a general, or a minister, simply becouse he was not born noble? WHY should birth LIMIT a person? If birth did not matter, what of the view that kings ruled by divine right? IF rule was NOT by divine right..How were governments to be set up?

By contract of course.

      Among nobles your WORD given to another noble was unquestioned. The word of a noble was the word of a noble...BUT that word was mostly given to another noble. In most cases a noble would not even talk to a common directly..The lord would tell the lesser noble who would tell the servant who would tell you.  (Think about it. If the CEO wants a hamburger and  a coke from burger king. He or she  does not go there or even call Burger King..He/she  tells someone who tells someone who sends someone to pick up that meal.)

Among the middle class, which started as a business/ trade class however  almost all everything was done by written contract. "I, jones will give you 3 nice  sheep  on monday and you Frank,  give me 5 good chickens on friday."

Now what is wrong with that "contract"?
 Define " nice"  Perhaps to me "Nice" is a 3 legged half dead sheep. Is  that what you expected?
 Or "good"  Perhaps to Frank a "good' chicken is half dead.  Is that what Jones expected?

So both men  feeling cheated, go to 'Court" the judge reads the contract, and tosses the case out of court. Both learn to hire people who KNOW how to write a good contract.
