Constitution 101

The problem with kings is that you never know how the next one is going to turn out and you live with that for perhaps 50 years or  civil war..

The Constitution  is based on the sound principle that people are in general power mad  and greedy!
So the whole system is set up to use human nature to balance human nature.

The President can check the congress..and Congress can check the President and even if it is not in my view constitutional, the courts have by tradition the power to declare a law unconstitutional and even suggest remedy  ( make law from the bench) Plus the  American jury can make any law null and void by simply refusing to convict..

All this and a lot more is done to keep the awesome power of the state in check.

HW...Why not just trust in the noble newman?

Constitution 101 American view of law

Americans as a people almost worship freedom and the rights of free people.
That is why we make it so very very hard to pass laws.
In the American view while a law may well be needed any law by definition  is saying "NO"
While we agree that something SHOULD be said "NO" to..murder ..stealing..rape..perjury..That does not make the general concept of law beloved by Americans.
So if DC  Or your local town council cannot seem to agree.that IS the way the system was set up.
For example Mr Trump is President  and Mr Obama was president and no matter what some of their supporters may have hoped or wished  a president is NOT a king.


HW..It has been said with much justice that a good king is the most perfect and just  form of Government. So why do we not have a monarchy? Think about it.

Constitution 101 Government controlled

Anyone can set up a strong government and anyone can set up a weak government !
The hard part it to set up a balanced government.
We did in with several tools.
A. Share different types of power among THREE levels of government
B. Create a tension between  the powers of each level  so that they keep themselves in check.

Hw: Think about that? Why not just give one guy all of the power?

How a law is passed or repealed ( short version) Constitution 101

We wanted NO king or all powerful parliament
Thus, we made it hard for the federal government (or any government) to pass or repeal a law.
Both houses of Congress..The House of Representatives and the Senate must after long debate AGREE on a bill and Vote that agreement and only THAN is that Bill sent to the President for his or her signature and only THEN is that Bill a law.
The president may NOT repeal or pass a law on his own....That is an impeachable offence..(one by the way that Mr Obama came very very close to.)
The President may issue EO to the Executive dept only as long as those EOs are within the laws that set up and control that department.
BUT  the president may NOT create or repeal LAW.

So if Obamacare is not repealed or a tax law is not changed  at this point BLAME the Congress
Now if Congress passes said laws and the President vetoes that  only then may you  with justice blame the President.

Constitution 101 If we cannot trust the KING who can we trust?

If we cannot trust the KING who can we trust?
That was the question after we became independent.
Local officials? Ok we need some social order and we can control them.
Note the word "control"? that was the question.
you have to understand. Americans WANTED to be free..and as time has passed more and more of us WANT that freedom!
So the question is:  How to KEEP freedom?
The problem: How to balance freedom and order?

The first thing you better understand is that the Americans grew up thinking themselves BRITISH
And they  were very very proud of that. In fact there were  only two types of people in the world British subjects and those who wished that they were. All of the problems and there were some especially after the French and Indian war were blamed on evil ministers..surely oh surely  his royal highness KING George lll would save us. So when the Royal Army put the boot in, Americans got one hell of a wake up call.

 The Constitution is the social contract of the American people, not a "world wide declaration of human rights" and as a contract it means what it says and ONLY what it says and can ONLY be changed by the rules written with in that contract!!!! AND is only binding on the people who are covered by it !!DUHH We are the American Republic   not the American  New world order. ( aka  Empire)

Stanley the snake came slithering up to the garage where Bob and Grrr were passing the time over root beer and coffee.
"Hey ya bum!" roared a happy Grrr and "Welcome Stan" said Bob.
"If ya dont mind my asking Stan,  you look kinda beat..shedding  the ole skin again pal?" Asked  Grrr. as he put down a plate of milk for his snake friend.
"Nothing like that."  Hissed Stanley  "Well yes I have but for a snake that is not the problem..I got issues"
"I told you to lay off that day time TV pal" said Bob
"Yeah. A guy cannot watch that stuff without getting nuts.." Agreed Grrr.

Not a good night but one we needed

Ok so the PC seem to have won big and NO I dont like that.
But it may well be the wake up call we need.
This is not a moderate age.
You are on one side or the other and if you dont realize that, you will lose.
